General Terms and Conditions – Short Bear VOF
Article 1 – Definitions
In these general terms and conditions, the following terms are defined as:
a. Short Bear VOF: the provider of luxury ski trips, established in the Netherlands;
b. Client: any natural or legal person entering into an agreement with Short Bear VOF;
c. Services: the trips and packages organized by Short Bear VOF, including accommodation, guide services, and other activities.
Article 2 – Applicability
- These terms and conditions apply to all offers, agreements, and services provided by Short Bear VOF.
- Deviations are only valid if agreed upon in writing.
Article 3 – Formation of Agreement
- The agreement is concluded after confirmation of the offer by the client.
- Bookings are confirmed upon receipt of a deposit of 25% of the total amount.
- The remaining amount (75%) must be paid no later than 30 days before departure.
Article 4 – Prices and Payments
- All prices include VAT unless stated otherwise. Where applicable, the special scheme for travel agents (Article 306 of Directive 2006/112/EC and Article 25 of the Dutch Turnover Tax Act 1968) applies.
- In the event of late payment, Short Bear VOF reserves the right to terminate the agreement.
Article 5 – Cancellation by the Client
- For cancellations up to 60 days before departure, the client owes 25% of the travel sum.
- For cancellations between 60 and 30 days before departure: 50%.
- For cancellations within 30 days before departure: 100%.
Article 6 – Liability
- Participation in activities, especially those under the guidance of mountain or ski guides, is entirely at the client’s own risk.
- Short Bear VOF is not liable for any damage, injury, or loss arising from participation in activities organized or supervised by third parties.
- The client indemnifies Short Bear VOF against any claims from third parties resulting from the client’s conduct during the trip.
Article 7 – Insurance
- Clients are strongly advised to take out adequate travel insurance covering winter sports and off-piste activities.
- Short Bear VOF is not responsible for arranging insurance on behalf of the client.
Article 8 – Force Majeure
In the event of force majeure (such as extreme weather, closure of ski areas, natural disasters, etc.), Short Bear VOF reserves the right to suspend or cancel the agreement without being liable for any damages.
Article 9 – Applicable Law and Disputes
- All legal relationships are governed exclusively by Dutch law.
- Disputes shall be submitted exclusively to the competent court in the district where Short Bear VOF is established.
